E.-4 21-0315 Adoption by the Board of Education of Resolution No. 2021-0038 - Waiver of Certain Proposition 39 Obligations During the COVID-19 Pandemic.
CCSA opposes Resolution No. 2021-0038 which directs the Superintendent to seek a “waiver” of OUSD’s voter mandated Prop. 39 obligations in direct violation of law, in obvious breach of its very recent settlement agreement with CCSA and in rank disregard for the Districts students served by charter public schools that would have no facilities. There is no lawful path for the District to “waive” or “forgo” compliance with the will of the people through a voter enacted initiative like Prop. 39 and any effort to do so is an unequivocal breach of the settlement agreement that OUSD entered into last September with full knowledge of the pandemic.
