What took place at today's meeting was, even though the meeting agenda C. did not "provide an opportunity" for public comment, the Board President allowed my public comment.
I thank the Board President for allowing me to address the Board on agenda item C.
But the violation of the Brown Act remained, in spite of the Board President's action allowing to comment, because public's right to address all agenda items before or after the Board's consideration of each agenda item cannot be amended by the legislature changing a right of the public to public comment to the discretion of a Board President to decide if there will be public comment.
Since 1953 Oakland School Boards have practiced allowing public comment on all agenda items. The amendment of Board Bylaw 3322 in December 2020 changed that practice. Please School Board restore the past practice.
