15-0456 Approval by the Board of Education under the Community Recreation Act and Education Code section 17534 (b) ( Joint Use Lease Agreement if capital outlay improvements are made on school property for park and recreation purposes by public entities and nonprofit) of Binding Letter of Intent to enter into Ground Lease and Joint Use Agreement with Education for Change ("EFC"), for the use of the former OUSD School Site, Lazear Elementary School, located at 824-29th Avenue, Oakland, CA 94601 to commence July 1, 2015, for a twenty (20) year term, subject to earlier termination if Education for Change/Lazear's program ceases to operate after a revocation, nonrenewal or surrender of the charter to the granting agency, and all appeals have been exhausted, and two additional terms of ten (10) years each, at Education for Change's discretion, at the Facility Use Fee for the five year initial term of $3.80 per square foot, based upon 29,531 square feet or $112,217.00 per year.
